Version 1.0 · Last updated: 23 October 2026
These terms are a contract between you and Spreetech Limited (RC 9939578), 29 Park Road, Ebute Metta, Lagos State, Nigeria ("Spree", "we", "us"). They apply when you use the Spree app, the Spree Rider app or onspree.co.
Please read them. Section 15 limits our liability and section 9 explains what you pay when an order cannot be delivered; we have highlighted both. Nothing in these terms takes away your rights under the FCCPA or any other law that protects consumers.
If you run a shop, the seller agreement applies to you as well. If you ride, the rider agreement does. Our privacy policy explains how we use your data.
1. What Spree is
1.1 Spree is a marketplace where independent shops in Lagos ("sellers") list clothes, shoes, bags and accessories, and buyers order them. Spree arranges the delivery of every order with an independent rider, vetted by Spree, who works through the Spree Rider app. Spree is responsible to you for the delivery.
1.2 The seller sells you the goods. When you order, your contract for the goods is with the seller, whose shop name is shown on every piece and order. The seller is responsible for the goods being as described, lawful, genuine, of good quality and fit for their purpose.
1.3 Spree provides the service around the sale: the app, taking your payment, delivering your order, the returns process in our returns policy, and support. Our contract with you for that service is these terms.
1.4 Paying Spree is paying the seller. We collect your payment as the seller's limited agent. Once your payment is confirmed, you have paid for the goods in full, and the seller cannot ask you to pay again. If an order is refunded, we refund you.
2. Accepting these terms
2.1 You accept these terms by tapping to agree in the app, or by using Spree. Your acceptance is recorded electronically with the version and the time, and that record is valid evidence of the contract.
2.2 If you do not agree, do not use Spree.
3. Who can use Spree
3.1 You must be 18 or over and able to make a binding contract.
3.2 You sign in with your own phone number. Keep your phone and the sign-in codes we send you to yourself. Anything done on your account is treated as done by you, unless you tell us promptly that someone else got into it.
3.3 One person, one account. The information you give us must be true and up to date.
4. Pieces, prices and stock
4.1 Sellers post their own pieces, photos, descriptions, sizes and prices. We check shops before they open, but we do not inspect every piece. If a piece is not as described, the returns policy applies.
4.2 Prices are in naira. Before you pay, checkout shows you:
- the price of each piece, after any discount;
- the delivery fee, set by the road distance from the shop to your address;
- the Service & protection fee, which is ₦400 plus 3.5% of the pieces, at least ₦500 and at most ₦3,000. It pays for running the order: payment processing, support, delivery tracking and the protection in these terms;
- the total, and the day your order should arrive.
4.3 A checkout price is held for 10 minutes. What you pay is what you see; nothing is added afterwards.
4.4 If a mistake makes a price obviously wrong (for example ₦1,500 for a piece that sells for ₦150,000), the seller may decline the order and you get all your money back.
4.5 Every piece is labelled new or used by the seller. Thrift is used. A used or refurbished piece must say so and show its faults.
5. Placing an order
5.1 When you pay, the pieces are held for you. If payment is not completed within 30 minutes, the order lapses and nobody is charged.
5.2 Payments are handled by Paystack, by card or bank transfer. Your card details go to Paystack, never to us. An order is paid only when Paystack confirms it.
5.3 After you pay, the seller has 15 minutes to accept (counted from when the shop opens, if it is closed when you order). The order is confirmed when the seller accepts it. If the seller declines or does not answer in time, the order is cancelled and you get everything back.
5.4 If a shop is closed, you can still order; the app tells you before you pay when the order should arrive.
6. Cancelling
6.1 Before the seller accepts: cancel in the app and you get everything back.
6.2 After the seller accepts, the order is being packed and a rider is on the way, so the app no longer offers cancel. You can still turn the order down at the door before you give the delivery code (section 9).
6.3 If you cannot take an order because of the death or hospitalisation of the person it was for, tell us through Help and we will refund everything, including fees.
7. Delivery
7.1 Every order has its own rider, arranged by Spree. You can follow the parcel on the map once it is collected.
7.2 The arrival time shown before you pay is our estimate. If a delivery is going to be late, we will tell you. If it is late because of us, you may ask us through Help to refund a fair part of the delivery fee (FCCPA section 130).
7.3 The delivery code. Your order has a four-digit delivery code, shown only in your app. The rider takes the code before handing over the parcel. Give it only to the rider in front of you, and only when you are ready to accept the parcel. Giving the code confirms you received that parcel in the condition you saw. Never share the code by phone or message with anyone you cannot see at your door.
7.4 The person receiving the parcel can be someone else you name at checkout. They act for you.
7.5 Ownership and risk. The goods are yours, and the risk of loss or damage passes to you, when the delivery code is entered. Until then, the seller and Spree carry that risk between them, and you are refunded in full if the parcel is lost or damaged in transit.
8. If nobody is at the address
8.1 When the rider arrives and cannot reach you, we send you a notification and a text, and the rider waits 10 minutes.
8.2 If you do not give the code in that time, the parcel goes back to the shop. You get the price of the pieces back. The delivery fee and the Service & protection fee are not refunded, because the rider made the trip.
9. Turning an order down at the door
Please read this section. Before you give the delivery code you can look at the parcel and turn it down:
| Why you turn it down | What you get back |
|---|---|
| The package is visibly damaged | Everything |
| It is the wrong package | Everything |
| You have changed your mind | The price of the pieces. The delivery fee and the Service & protection fee are kept, because the delivery was made |
Keeping the fees when you change your mind at the door is our cancellation charge (FCCPA section 120). It is never more than the fees you paid for that delivery.
After you give the code, a problem is handled under the returns policy.
10. Returns and refunds
10.1 Our returns policy is part of these terms. In short: report a problem in the app within 24 hours of delivery with at least two photos and it is handled quickly, collected by a rider arranged by Spree and refunded. Your legal right to return goods that are defective, unsafe or not as described is not limited by that 24-hour window; see the returns policy.
10.2 Refunds go back to the card or account you paid from, through Paystack. We send a refund within 2 working days of it becoming due. Your bank may then take a few working days to show it.
10.3 A refund is never made in cash or to a different person.
11. Gbanjo drops, promotions and codes
11.1 Gbanjo drops are limited sales run by sellers at a set time. A piece you claim in a drop is held for you at the drop price for 10 minutes. If you do not pay within that time, it goes back to the drop for someone else.
11.2 Promotion codes are offered by sellers, with the conditions shown in the app (who can use them, how many times, and until when). A discount comes off the pieces, not the delivery fee. Codes cannot be exchanged for cash.
11.3 Sellers set their own "was" prices and discounts and must not mislead you with them (FCCPA section 123). Report one that does.
12. Reviews, reports and what you post
12.1 You can leave one public review of a shop for each order delivered to you, and private feedback on the rider. Reviews must be honest, about your own experience, and must not include anyone's phone number, address or other private details.
12.2 We may remove reviews, photos or messages that are false, abusive, hateful, sexual, threatening, spam, or that break the law or these terms. We never remove a review only because it is negative.
12.3 You keep ownership of what you post. You give Spree a free, non-exclusive licence to show it in Spree and in Spree's own promotion of Spree, for as long as it is on Spree.
12.4 You can report a piece, shop or review from the app. We look at every report.
13. How you must not use Spree
You must not:
- buy, sell or ask for anything on the prohibited items list;
- pay, or ask anyone to pay, outside Spree for an order started on Spree, or arrange a delivery outside Spree with a Spree rider;
- give false information, use someone else's account, phone number, card or identity, or open accounts to get around a suspension;
- abuse, threaten, harass or discriminate against a seller, rider, buyer or Spree staff;
- make false return claims, false chargebacks or false reports;
- copy, scrape or reverse-engineer the apps, interfere with them, or use them to send spam or malicious code;
- use Spree for any unlawful purpose.
14. Suspending or closing your account
14.1 You can delete your account in the app at any time (privacy policy, section 10).
14.2 We may suspend or close an account that breaks these terms, puts others at risk or is used for fraud. We will tell you why, unless the law or an investigation prevents it, and you can ask for a review through Help. Suspension does not cancel refunds owed to you.
15. Our responsibility to you
Please read this section.
15.1 We provide our service with reasonable care and skill and within a reasonable time (FCCPA sections 142 and 143). If we do not, tell us and we will put it right or refund a fair part of what you paid us.
15.2 We are responsible for loss or damage to your parcel while a Spree rider has it, and you will be refunded in full.
15.3 The seller is responsible for the goods themselves (section 1.2). We help you enforce that through the returns policy.
15.4 We are not responsible for losses we could not reasonably have foreseen, for loss of business or profit, or for delays and failures caused by events outside our reasonable control, such as public disorder, severe flooding, strikes, government action or a nationwide network outage.
15.5 Apart from refunds owed to you under these terms and the returns policy, our total liability to you for any order is limited to the total you paid for that order.
15.6 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for gross negligence, or for anything the law does not allow us to limit, including your rights under the FCCPA (sections 129 and 136 to 141).
16. Spree's name and app
The Spree name, logos, apps and website belong to Spreetech Limited. We give you a personal, non-transferable right to use the apps for their purpose. You may not use our name or marks without our written permission.
17. Problems and complaints
17.1 Tell us first through Help in the app, or at [email protected]. We reply within one working day and aim to settle a complaint within 14 days.
17.2 If we cannot settle it, you may complain to the Federal Competition and Consumer Protection Commission (fccpc.gov.ng), the Nigeria Data Protection Commission (ndpc.gov.ng) for a data matter, or go to court (FCCPA section 146). These terms do not stop you from doing any of that at any time.
17.3 If you have a complaint about a seller, we will help you settle it, and we may decide a refund under the returns policy.
18. Changes to these terms
18.1 We may change these terms, for example when the law or our service changes. We will publish the new version with a new version number and date and, for a significant change, tell you in the app at least 7 days before it applies, unless the change is required by law sooner.
18.2 You will be asked to accept the new version before your next checkout. If you do not accept it, you may stop using Spree and delete your account; an order already placed stays under the terms you accepted for it.
19. App stores
19.1 These terms are between you and Spreetech Limited, not Apple or Google. Apple and Google are not responsible for the apps, their content, support or any claim about them. Your use of the apps must also follow the app store's own rules.
19.2 If you downloaded an app from Apple's App Store: Apple has no duty to provide maintenance or support for the app. If the app fails to meet any warranty that applies to it, you may tell Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Spree, not Apple, is responsible for any claim relating to the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection and privacy claims, and claims that it infringes someone's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country subject to a United States government embargo and are not on a United States government list of prohibited or restricted parties.
20. General
20.1 Law and courts. These terms are governed by the laws of the Federal Republic of Nigeria. The courts of Lagos State may hear any dispute, without taking away your right to approach any court or regulator that the law allows.
20.2 If a court finds part of these terms invalid, the rest still applies.
20.3 If we do not enforce a right straight away, we have not given it up.
20.4 We may transfer our rights and duties under these terms to a company that takes over Spree, and we will tell you. You may not transfer yours.
20.5 We will send you notices in the app, by text message or by email. You can send us notices through Help, at [email protected], or to our registered office.
20.6 These terms, together with the returns policy, the prohibited items list and the privacy policy, are the whole agreement between you and Spree about using Spree as a buyer.
